The Ohio Supreme Court has scheduled oral arguments in a highly anticipated case that questions the constitutionality of Governor John Kasich's privatized economic development organization, JobsOhio. The Supreme Court will hear the case on November 6, beginning at 9 a.m.

The lawsuit was filed by two Democratic state representatives and the liberal advocacy group ProgressOhio. It was thrown out in common pleas and appeals courts by judges ruling that the groups did not have legal standing to challenge the constitutional status of JobsOhio. To date, no court has decided on the basic question of whether JobsOhio is constitutional or not.

The court could opt to limit its ruling to the "standing" issue, which would send the case back to common pleas court for the consideration of the actual merits of the lawsuit. Alternatively, the court could decide to hear the entire case, including standing and constitutionality.
